CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION & RETURN CONDITIONS

GENERAL:

By placing an electronic order through the website you are currently using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.

Buyers are subject to the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), as well as other applicable laws regarding the sale and delivery of the product they purchase.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

The Buyer shall inspect the contractual goods/services before receiving them; the Buyer shall not accept damaged or defective goods/services (such as dented, broken, torn packaging, etc.) from the cargo company. The received goods/services shall be deemed to be undamaged and intact. The BUYER is obliged to carefully protect the goods/services after delivery. If the right of withdrawal is to be exercised, the goods/services must not be used. The Invoice must also be returned along with the product.

RIGHT OF WITHDRAWAL:

The BUYER may exercise their right of withdrawal from the contract by rejecting the goods within 14 (fourteen) days from the date of delivery to themselves or to the person/organization at the designated address, without assuming any legal or criminal liability and without giving any justification, provided that they notify the SELLER via the contact information below.

The product requested to be exchanged or returned must be delivered to the seller complete, in accordance with the specifications stated in the order, and along with documents such as the warranty certificate and user manual, if any.

In the event that the sale of the purchased product becomes impossible, the seller must notify the buyer of this situation in writing within 3 days from the date they learn about it. The total amount must be refunded to the Buyer within 14 days.

IF THE PRICE OF THE PURCHASED PRODUCT IS NOT PAID:

If the Buyer does not pay the price of the purchased product or cancels it in the bank records, the Seller's obligation to deliver the product shall cease.

SHOPPING MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

After the product is delivered, if it is determined that the credit card used for payment by the buyer has been used unfairly by unauthorized persons and the price of the product sold is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the contractual product to the SELLER within 3 days, with the shipping costs covered by the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED WITHIN THE DUE TIME DUE TO UNFORESEEN REASONS:

If force majeure events occur that the Seller could not foresee and the product cannot be delivered within the due time, the situation shall be notified to the Buyer. The Buyer may request the cancellation of the order, the replacement of the product with a similar one, or the postponement of the delivery until the obstruction is removed. If the Buyer cancels the order; if the payment was made in cash, this fee shall be paid to them in cash within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels it, the product price shall be refunded to the bank within 14 days from this cancellation, but it is possible for the bank to transfer it to the buyer's account within 2-3 weeks.

The expenses arising from the exercise of the right of withdrawal belong to the SELLER.

In order to exercise the right of withdrawal, a written notification must be sent to the SELLER within a 14 (fourteen) day period via registered mail, fax, or email, and the product must not have been used within the framework of the "Products for which the Right of Withdrawal Cannot Be Exercised" provisions regulated in this contract.

EXERCISE OF THE RIGHT OF WITHDRAWAL:

The invoice of the product delivered to the 3rd person or to the BUYER (If the invoice of the product requested to be returned is corporate, it must be sent together with the return invoice issued by the institution when returning it. Order returns issued on behalf of corporations cannot be completed unless a RETURN INVOICE is issued.)

The return form, the box, packaging, and standard accessories, if any, of the products to be returned must be delivered complete and undamaged.

RETURN CONDITIONS:

The SELLER is obliged to refund the total price and return the documents that put the BUYER under debt to the BUYER within 14 days at the latest from the receipt of the withdrawal notification, and to take back the goods within 20 days.

If there is a decrease in the value of the goods or if the return becomes impossible due to a reason caused by the BUYER's fault, the BUYER is obliged to compensate the damages of the SELLER in proportion to their fault. However, the BUYER is not responsible for the changes and deteriorations that occur due to the proper use of the goods or products within the right of withdrawal period.

If the campaign limit amount set by the SELLER falls below the threshold due to the exercise of the right of withdrawal, the discount amount utilized within the scope of the campaign shall be cancelled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

In order to be eligible for a return, the packaging of the products must be undamaged, and the products must be unused, unblemished, shock-free, untried, and unspoiled.

If a regular modification or deterioration occurs in the purchased product within the right of withdrawal period, the consumer shall not be held responsible. However, if a deterioration or modification occurs in the product due to the consumer's negligence or intent, the consumer shall be held responsible for it.

DEFAULT STATUS AND LEGAL CONSEQUENCES

The BUYER accepts, declares, and undertakes that if they default in the case of making payment transactions with a credit card, they will pay interest and be responsible to the bank within the framework of the credit card agreement between them and the cardholder bank. In this case, the relevant bank may take legal action; may claim the costs and attorney fees from the BUYER, and in any case, if the BUYER defaults due to their debt, the BUYER accepts to pay the damage and loss suffered by the SELLER due to the delayed performance of the debt.
